By booking a charter through YachtiFi LLC (“YachtiFi”), the individual making the reservation (“Charterer”) acknowledges that they have read, understood, and agree to these Terms & Conditions on behalf of themselves and all guests participating in the charter.
The Charterer represents that they are at least 18 years of age and have the legal authority to enter into this agreement.
YachtiFi LLC serves solely as a booking and administrative platform that coordinates independent service providers.
By proceeding with the booking, the Charterer authorizes YachtiFi LLC to collect payment and facilitate two separate transactions:
• A bareboat rental agreement between the Charterer and Big Blue Dockside LLC, the independent owner of the charter vessel.
• A captain-for-hire agreement between the Charterer and Salt Mode LLC, an independent provider of licensed captain services.
YachtiFi is not the owner, operator, master, crew, or charter provider of any vessel and does not provide transportation services.
The Charterer and all guests acknowledge that participation in boating and maritime activities involves inherent risks, including but not limited to:
Rough water and changing sea conditions
Weather-related hazards
Slips, trips, and falls
Mechanical or equipment failure
Boarding and disembarking hazards
Swimming and water-related injuries
Collision with other vessels or objects
Marine wildlife
Illness, seasickness, or physical exertion
By participating in the charter, each guest voluntarily assumes all risks associated with the activity.
Prior to boarding, each adult guest may be required to execute a separate liability waiver.
To the fullest extent permitted by applicable law, the Charterer and all guests release, waive, and discharge Big Blue Dockside LLC, Salt Mode LLC, YachtiFi LLC, and each of their respective owners, officers, employees, contractors, captains, crew members, agents, affiliates, successors, and assigns from claims arising out of personal injury, property damage, illness, loss, or death resulting from participation in the charter, except where prohibited by law or resulting from gross negligence or willful misconduct.
The Charterer agrees to indemnify, defend, and hold harmless YachtiFi LLC, Big Blue Dockside LLC, Salt Mode LLC, and their respective owners, employees, contractors, and agents from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from:
The acts or omissions of the Charterer or any guest
Damage to the vessel or equipment
Violation of applicable laws or regulations
Breach of these Terms & Conditions
The Charterer represents that all guests are physically and mentally capable of participating in the charter.
No person should board while impaired by alcohol, drugs, or any medical condition that would make participation unsafe.
The Captain retains sole discretion regarding whether any individual may safely board or remain aboard.
The licensed Captain provided through Salt Mode LLC has complete authority over the safe operation of the vessel.
The Captain may:
Refuse boarding to any individual
Modify the itinerary
Return to port early
Terminate the charter
Remove any guest whose behavior creates a safety concern
Safety decisions made by the Captain are final and are not grounds for a refund.
The Charterer agrees that all guests will:
Follow all instructions from the Captain and crew
Comply with all applicable federal, state, and local laws
Respect the vessel and its equipment
Refrain from dangerous, reckless, or illegal conduct
The Charterer accepts financial responsibility for damage caused by themselves or their guests beyond ordinary wear and tear.
By submitting payment, the Charterer authorizes YachtiFi LLC to collect funds on behalf of the independent service providers and distribute those funds accordingly.
Once a reservation has been confirmed, the vessel reserved, and captain services arranged, cancellation policies apply as stated during the booking process.
No refunds will be issued after the charter has commenced except when the charter is canceled due to mechanical failure, vessel unavailability, or other circumstances determined by the vessel owner.
If the Captain determines that weather or water conditions make operation unsafe, the Charterer will be offered either:
A rescheduled charter, subject to availability, or
A refund in accordance with the applicable cancellation policy.
Late arrivals or no-shows may result in forfeiture of all amounts paid.
Unless the Charterer provides written notice before departure requesting otherwise, YachtiFi LLC may use photographs or video captured during the charter for advertising, promotional, and marketing purposes without additional compensation.
This agreement shall be governed by applicable United States maritime law and, where maritime law does not control, the laws of the State of New York.
Any provision found unenforceable shall not affect the validity of the remaining provisions.
These Terms & Conditions, together with any signed charter agreement, booking confirmation, and required waivers, constitute the complete agreement between the parties.
Any modification must be in writing and signed by the applicable parties.
By completing the booking and submitting payment, the Charterer expressly authorizes YachtiFi LLC to act as a payment collection and administrative facilitator.
The Charterer acknowledges that payment to YachtiFi LLC satisfies the Charterer’s payment obligations for:
The bareboat rental provided by Big Blue Dockside LLC; and
The licensed captain services provided by Salt Mode LLC.
YachtiFi LLC will receive payment and allocate the applicable amounts to each independent provider on the Charterer’s behalf.
The Charterer understands that YachtiFi LLC is not the vessel owner, charter operator, captain, or transportation provider, but solely facilitates the booking and administration of these independent agreements.
