By booking or boarding through YachtiFi (“the Company”), you (“Guest”) agree to these Terms & Conditions and confirm you are of legal age and competent to enter this agreement.
Guest acknowledges that boating involves inherent risks, including but not limited to: rough waters, weather changes, sea sickness, slips, collisions, equipment failure, physical strain, and marine wildlife encounters. Guest accepts full responsibility for these risks.
Prior to boarding, Guest must sign a liability waiver acknowledging the risks and releasing the Company, its employees, crew, and agents from all liability—even if caused by negligence—except in cases of gross negligence or intentional misconduct.
Guest warrants they are physically and mentally fit to be on a vessel underway and will not board if impaired or unwell.
Guest fully releases YachtiFi and its crew from claims relating to personal injury, property damage, or death, whether caused by Guest’s own acts or those of others or by the vessel’s condition.
Guest agrees to indemnify and hold harmless YachtiFi from any injury, damage, or legal action brought by Guest or third parties.
All payments are final once the following conditions are met: booking confirmed, crew assigned, and vessel scheduled. No refunds will be issued after boarding occurs, except when the vessel is canceled by YachtiFi due to mechanical or crew issues.
Weather-related cancellations at the Captain’s discretion entitle Guest to a full refund or rescheduling. Time-related no-shows may forfeit payment.
The Captain has absolute authority to refuse boarding, terminate trips mid-journey, or modify plans for safety reasons. Behavioral or safety violations may result in no refund and immediate removal from the vessel.
Guest agrees to follow all safety instructions, vessel rules, maritime laws, and any applicable local regulations. Illegal behavior or failure to comply may lead to removal and liability for related costs.
YachtiFi may take photos or videos during the trip for marketing purposes unless the Guest opts out in writing. Participation in a booking serves as consent for such use.
If any clause is found unenforceable, the remainder of this agreement remains valid. This agreement is governed by United States maritime law and the laws of the State of New York.
These Terms & Conditions constitute the entire agreement between Guest and YachtiFi. Any changes must be made in writing and signed by both parties.
YachtiFi is a booking platform only and does not own or operate any vessels. All charters are provided by independent, partnered vessel owners. By booking through YachtiFi, you acknowledge and agree that you are entering into a charter agreement directly with the vessel owner or operator, not with YachtiFi itself. YachtiFi assumes no responsibility for the operation, maintenance, or seaworthiness of any vessel and acts solely as a booking intermediary.
